Lawsuits Allege Illegal Promotion of Risperdal
In a September 2012 jury trial, former company manager Tone Jones testified about Johnson & Johnson's promotion of Risperdal to child psychiatrists. He testified that the company paid physicians to give favorable speeches, subsidized golf trips, and increased visits to doctors who treat children. According to Jones, these promotional efforts took place as early as 2003. The FDA did not approve Risperdal for use in children, however, until 2006 and 2007. If true, this type of "off-label" promotion may have subjected Cary children and adolescents to Risperdal side effects such as gynecomastia without proper regulatory oversight by the FDA.
In fact, the former commissioner of the FDA submitted a report in a separate Risperdal trial affirming Jones's testimony. According to the report, the manufacturer promoted Risperdal for use in children and adolescents before it was FDA-approved, a violation of the Federal Food, Drug, and Cosmetic Act. The former official called such off-label promotion "deeply troubling" because "it undercuts the system and safeguards of drug regulation" designed to protect U.S. consumers in Cary and nationwide.
